City Planning Commission.
Summary
What happened (overall context)
- Event: New Orleans City Planning Commission meeting focused on a data-center text amendment framework, use standards, and related regulatory considerations.
- Purpose: Define how data centers would be classified (four-category framework), where they would be allowed (conditional uses in certain districts/overlays), design/operational standards (density, sound, safety, etc.), and how they interact with existing processes (pre-review, agency reviews, and institutional master plans for certain facilities).
Key decisions, votes, and actions (as stated in the material)
- Staff recommendation: The staff proposed approving the text amendment framework and use standards for data centers.
- Public-comment/deferral context: A deferral request was raised by ENNAC (Eastern New Orleans Neighborhood Advisory Commission) to delay full consideration for at least 60 days to allow more community input and proper notice; the meeting notes identify this as an unresolved item to be resolved by the Commission (or with staff/counsel guidance). The CPC deadline for action cited in the material is October 23.
- Final vote on the deferral and on the staff recommendation: The material provided does not include a clearly recorded final vote on the staff recommendation, nor a definitive final deferral decision within the excerpt. Some later passages (in other excerpts) describe a deferral outcome differently, but the primary excerpt with the most complete details notes the deferral request and unresolved status rather than a final recorded vote.
- Next steps outlined (if the docket proceeds or deferral is granted): Resolution of the deferral process, notification/outreach questions, and continuing review of the data-center framework (including four-category structure, conditional-use provisions, pre-review requirements, setbacks, CBD provisions, institutional master-plan options, and on-site power-generation rules beyond backups).
Speakers and positions (clear speakers and gist)
- Susan Johnson (2822 LePage Street, Town of Carrollton Watch, Historic New Orleans Neighborhoods): Supported deferral to expand outreach/input.
- Sue Mobley (3801 North Roman): Supported staff recommendations and praised the staff report; also voiced support for a comprehensive ban on large/hyperscale data centers.
- ENNAC representative: Kenya Smith (interim president) spoke via letter calling for at least a 60-day deferral to enable meaningful community input and proper notice; highlighted notification concerns under applicable law.
- Additional context from the hearing notes (in this excerpt) reflects input from other stakeholders on the general acceptability of the staff approach and on broader concerns about large-scale data-center projects, but the named public-comment speakers above are the clearest in the provided material.
Unresolved issues to watch
- Whether the CPC will defer the docket for 60 days (as requested by ENNAC) or proceed with full consideration, and how the Oct. 23 deadline would be affected (including any Council extension).
- Whether ENNAC and other community groups received proper notice, and what additional outreach is required before proceeding.
- Finalization of docket specifics if not deferred, including the four-category framework, conditional-use provisions, pre-review requirements, setback/distance rules (such as 500 feet from residential properties and 500 feet between centers in certain districts), CBD constraints (one data center per building), and the on-site power-generation policy.
- Whether and how to incorporate public input into any final recommended framework.
Notable notes about the material
- There are multiple excerpts with overlapping but sometimes conflicting details about the deferral outcome (some passages claim a 60-day deferral; others describe unresolved status or different durations). The primary excerpt with comprehensive detail states that a deferral was requested and that the outcome and related issues were unresolved at that point.
- The material also references related topics (e.g., pre-review by CURO, Entergy, and Sewage and Water Board; agency review statements; institutional master plan paths; and planning/design considerations) that would factor into a final decision if the docket moves forward.

See you. Commissioner Hebert? Here. Commissioner Flick? Present. Commissioner Whittry is here. Commissioner Sieg? Here. Thank you. We would like to go ahead and read the rules. The City Planning Commission has established certain rules governing the procedures to be followed at all public hearings. Commissioner Jackson is here as well. We welcome him. Before speaking, each person shall give their name, address, and state who he or she is representing. Proponents for proposal will speak for a period of 10 minutes. Each speaker will be allowed a maximum of two minutes. Opponents or other interested parties will speak a period of 15 minutes. Each speaker shall be allowed a maximum of two minutes. Proponents will be allowed a period of six minutes for a rebuttal. Each speaker shall be allowed a maximum of two minutes. Opponents will not be allowed to rebut. No material, written matter, photographs, maps, charts will be accepted by the commission or its staff at any time during this public hearing. This procedure shall be followed except at such time when the preceding officer shall, and with the approval of commission members present, extend such time. I'm going to go ahead and ask for a motion for our adoption of our meeting minutes from August 11th. I'll make a motion to adopt the meeting minutes from July 20th. Thank you, Commissioner Flick. Is there a second? Second. Thank you, Commissioner Poche. Any discussion? Yes. I actually think I need to call everybody's name. Yes. So, Commissioner Stieg, how do you? Yes. Okay. Commissioner Whittry? Yes. Commissioner Flick? Yes. Commissioner Hebert? Yes. Commissioner Kepper? Yes. Commissioner Poche? Yes. All right. The meeting minutes have been adopted. Yes. Commissioner Jackson? Commissioner Jackson, thank you. I need to add you to my list. Welcome. And we are going to move on to the first zoning docket, 036-26. And if you're new to this room or you just walked in, if you would like to speak, we need you to fill out cards, and they'll be brought up to me so that we can make sure that everybody's heard. Zoning docket 036-26. All right. Zoning docket 036-26 was deferred from the CPC meeting on July 28th, but this presentation is largely the same, so we'll just begin. It's a request by city council motion for a text amendment to the CZO to define data centers and any related uses, to consider whether these should be permitted or conditional in any zoning district or overlay, and to implement appropriate use and design standards for the uses not limited to density requirements, soundproofing, and safety measures, and other regulations necessary. Staff quickly concluded that the data center use is an atypical one from what usually goes through CPC and that there is a large variation in intensity based on the size and scale of the use and the impacts from data centers are not just hyper-local land use impacts like occupancy, traffic, building design, and lighting, but can be much broader, impacting local supplies of energy or water and potentially creating major air quality, noise, or water quality issues for nearby residents. And the greatest impacts come from the really large facilities with power generation on site and or liquid cooling facilities on site, mostly hyperscale facilities. To inform the recommendations and reports, staff reviewed zoning and land use regulations across the country, either from county, state, or local governments. Staff found that regulations vary. Some cities or states or counties have moratoriums on data centers, either entirely or beyond some kind of threshold like 10,000 square feet or 50,000 megawatts of power, but there are different approaches across the country as the demand for data centers has significantly increased in the past few years. So recommendations. Staff recommends setting a scale for data centers by establishing four main categories based on square footage and energy consumption. Staff looked at data center regulations from other places to inform the thresholds along with research on existing data center providers. So the categories are accessory, small, medium, large, or hyperscale. Accessory data centers would serve a primary use at a site and would be no larger than 2,000 square feet and would take up no more than 25% of the gross floor area of the primary use. Small data centers are up to 20,000 square feet with no greater than 5 megawatts of power. Medium data centers are up to 100,000 square feet and no greater than 20 megawatts of power. And large or hyperscale is anything beyond the medium threshold, the 20 megawatts or 100,000 square foot, and would be prohibited citywide. Use permissions. Laura, can I ask you, can I interrupt you? Sure. I just want to make sure since people are listening and I just want to make sure I understood. Large and hyperscale are the same? Well, large and hyperscale are defined under the same category. Yeah. And those would be prohibited, yes. Right. So, okay. They're two different categories or are they the same? They're in one bucket together. So above medium. Say again? The way that we've written them is in one bucket together, like large or hyperscale. Right. So anything above medium. Because large, what we've found is that large are typically hyperscale and hyperscale are typically large. Okay. Anything above medium falls into that one bucket. Into that category. Okay. And that's 20? 20,000 square feet. In megawatts of 20 did I see on the last slide? Five. 100,000 square feet in 20 megawatts. 20 megawatts. Okay. Thanks. Okay. Okay. So small or medium data centers would be conditionally allowed across districts in articles 15, 16, and 17. In the commercial center areas and institutional campus districts, small would be conditionally allowed in C1, C2, C3, EC, MC, MS, or LS. In article 16, centers for industry small and medium are conditionally allowed in LI, light industrial, HI, heavy industrial, MI, maritime industrial, and VIP, business industrial park.
In article 17, the central business district, small would be conditionally allowed in CBD1, CBD2, CBD3, CBD4, CBD7, and medium would be conditionally permitted in CBD7. And there's a map on the next slide. Yeah. So you can see the map on this slide in the red and blue areas. Those are the commercial centers that would conditionally allow small data centers. The purple color includes LI, HI, MI, and VIP that would support small or medium conditionally. And the gray areas on the map show the areas within and around the CBD that would permit small as a conditional use. It also includes CBD7, which allows the medium-sized data centers, so use standards. So as we were looking at the data center use type, we realized there are a series of procedural considerations for the use that are atypical. A new data center would require a review and consideration from Entergy, potentially Sewage and Water Board, certainly building permits, and so we decided to stipulate these initial considerations as part of the use standards. First, all data center applications for conditional use must be pre-reviewed by Curo, Entergy, Sewage and Water Board, and a statement of review by those agencies would be required to be provided to CPC before an application could be made. Second, each application would be required to include a general impact assessment to provide information on electrical load, water usage, expected noise levels, and a description of the mitigation efforts to be undertaken. The building and site design is largely similar to other industrially permitted use types, which are required to comply with the underlying zoning district's regulations for bulk yard design and landscaping. Staff includes density and distance restrictions. So all data centers would be 500 feet, roughly three blocks, from all residentially zoned properties. In industrial districts, LI, HI, MI, BIP data centers would also be required to be 500 feet from one another. And in the CBD, only one data center is permitted per building to limit the potential for an entire building to become a data center. So there are examples of university campuses seeking to construct data centers nationwide. Staff includes an allowance for universities and medical facilities subject to the institutional master plan requirements in Article 15 to seek data centers as a use allowance within their master planning process. And lastly, all on-site power generation would be prohibited except for backup purposes. And so staff recommends approval of this language. We did receive a comment on Friday from Enonac requesting a deferral of this request. Could we get some counsel on that, on the deferral, especially because it is a text amendment? I don't think I've been in that situation, so I just wanted to be able to know what the process is. You all, as the commission, have the authority to act or defer within the time allotted. And Laura, can you remind everyone what the deadline for consideration is? This is October 23rd is our deadline. So Eastern New Orleans Neighborhood Association Advisory Commission, and along with that Katie Fennelmine, if she could read maybe that request. Okay. Yes. One second, we'll find it. Do you have it? I'm looking for it. Do you have it? Okay. You ready? Dear members of the City Planning Commission, on behalf of the Eastern New Orleans Neighborhood Advisory Commission, Enonac, I'm requesting that the New Orleans City Planning Commission defer full consideration and formal action on zoning docket 3626 concerning data centers scheduled for hearing on August 25th for at least 60 days. Given the significance and sensitivity of the matter we do not believe the community has been provided adequate time to review and discuss the CPC staff report. Additional time is needed to allow for full meaningful community input and dialogue before this matter proceeds. We also want to address the issue of notification. In accordance with the requirements of law applicable to ENRNAC, which is Louisiana Revised Statutes 3390 100.11, ENRNAC is required to receive notice of inter alia zoning matters affecting its jurisdiction. ENRNAC did not receive proper notification from the City Planning Commission regarding zoning docket 3626. For these reasons, ENRNAC respectfully requests that zoning docket 3626 be deferred for at least 60 days to provide sufficient time for proper notification, community review of the staff report, and additional community discussion before the matter moves forward. We are also requesting that the New York New Orleans City Council extend the deadline for CPC action on this important issue concerning the defining and regulation of data centers to allow for the above reference greater community consideration, input, and engagement. Sincerely, Kenya Smith, Interim President. Thank you. I would like to suggest that we move your presentations completed so that we can move on to listen to the people that have come here today and then we can make our decisions. We have two cards in support. Ms. Susan Johnson and then Ms. Sue Mobley. Please remember you need to state your name and address and you have two minutes. Susan Johnson, 2822 LePage Street, Town of Carrollton Watch, Historic New Orleans Neighborhoods. I'm not paid to be here. I support the request for deferral for extended community outreach and input. Thank you. Thank you. Ms. Mobley. Hi y'all. Sue Mobley, 3801 North Roman. I support the staff recommendations and report and I know how quickly a political concern at Council can become a procedural request for Planning Commission staff to rapid-fire assemble a report. And I want to commend the Planning Department for an extensively researched and tightly written report in short order. Like I imagine most of the people in this room, I support the comprehensive ban on large and hyperscale data centers in Orleans Parish.
I also appreciate the more nuanced set of recommendations that take into account current data center usage and the most likely kinds and locations of potential future expansions along our biomedical corridor and adjacent educational campuses. My previous concerns about potential dodges using lesser designations in close proximity seem well addressed by the 500-foot regulations from residential properties, 500 foot from each other, regulations for four of the zoning types, and the CBD limit on one per building. I also really appreciate the proposal for reapproval of conditional use for expansion and use by square footage increase in water or power and hope that it might be applied as a standard for the current data centers in Orleans Parish to prevent inadvertently advantaging existing businesses over emergent ones. Overall, an excellent job by Planning staff which I hope the Commission will vote to approve and recommend to Council. Thank you. Ms. Mobley, I would like to recognize you since you served for the City of New Orleans as a Planning Commissioner. Thank you for your service. I don't have any other cards in support. If that's the case then we're going to move for information only. I do have a card for an Ian Bailey, but I have a question. I have two people seated to you and they're in opposition but you're an informational only. So are you informational only? I can provide information this time. I can provide information for these two minutes and then I could do opposition for the other one. I have multiple comments. Okay, so we are going to do you have two minutes. Please state your name and address. Hello everyone. My name is Ian Bailey. I am a student at the University of New Orleans. I'm located at 2000 Lakeshore Drive and I want to use my time today to speak to you again about the importance of maintaining our water infrastructure in New Orleans. This is my third time having the privilege to speak to you all. I do want to acknowledge that I'm very grateful that y'all are still continuing to be public-facing about this topic. This topic is going to affect all of us in the city whether we realize it or not. So I want to talk about how the state of the water of the Sewage and Water Board is not in a state to support data centers of any scale. I did research between February 2025 and March 2026 that shows that the Sewage and Water Board had to issue 10 boil water advisories within that 12-month span showing that the Sewage and Water Board can't even provide water for the people who already live here, let alone these new industrial size uses. I also found in that research that over half of those documented boil water advisories occurred in New Orleans East where it is mostly black and brown and Asian communities, people of lower income who are affected the most by these decisions. So I wanted to bring that clearly to the discussion that we're talking about today. Even I was able to see a brother today who does on-the-ground journalism not even what the boiler water but the boil I'm sorry let me take my time I saw a brother today who does on-the-ground journalism showing spots where water is leaking from sewage pipes and where these things are just they look like they're not kept and these are issues that haven't even broken out into an emergency yet. The research that I did only showed documented failures from the boiler water from the Sewage and Water Board and so that I know that there's also other issues that exist that haven't even been documented yet that we still have to go back and find more research on more data on before we commit to a definition for data centers. Thank you for your time. Mr. Bailey if you would like to speak you still have four minutes. All right again I really appreciate the opportunity to come up here and speak. I am a son of South Louisiana even if my parents may tell you otherwise I'm from here this is my home. I was originally raised in LaPlaz, Louisiana and I've been living in New Orleans for the past five years. Being that I come from LaPlaz I saw firsthand what an extraction economy does to a community. I got my start in research doing a project in elementary school about coastal erosion in Louisiana before and after Hurricane Katrina and so from a very early age I was already tailored to look and see how the impacts of how we build and how we develop infrastructure has the impact on the amount of lives we can save and the amount of emergencies we can prevent. When you look at coastal erosion you can see that there's a bunch of issues that contribute to it but one of the major things that contributes to coastal erosion in South Louisiana is oil companies and how they literally dug canals through our bayous and our wetlands to extract oil and to exploit the land here and I was raised in the heart of Cancer Alley because these oil companies once they find the oil they need to refine the oil and so the in Cancer Alley between New Orleans and Baton Rouge these areas has a high concentration of these industrial uses and the contaminants and the pollution from these oil companies causes residents to suffer from cancer and respiratory illnesses at higher rates than the rest of the country. From this information I want to pay I want to pair the information with data from the COVID-19 pandemic where St.
John the Baptist Parish had the highest rates of mortality because of the the condition of the residents because they're at higher risk of cancer and respiratory illnesses more people died from COVID-19 and the these illnesses didn't just happen because of their family it happened because it's in the air that these companies yeah okay yeah no that's cool it's two more oh okay how do we magic great so what I was saying was that these companies made these conditions for the residents who live here so I'm encouraging you all to think a little bit more deeply about the conditions of accepting a new industrial use in this in this area I know that data centers and are a new industry that's emerging right now and I still would very much urge caution with how quickly we are rolling this out again I want to appreciate the fact that we've had these discussions for a few weeks if not months at this point and so I just want to reiterate that they have a history of companies in this state in this region who have caused conditions that hurt people and that kill people that's the point that I wanted to make initially in terms of actually looking at which I've put out today with the youth standards and the definitions that y'all have released that y'all are about to vote on I think that they need a little bit more work still one of the things is that's good about it is that it has a prohibition of large and hyperscale data centers we do not need that at all the second point though is about how the definitions are really based on square footage and electricity use when water is more scarce than electricity water is my main issue because we need water to exist every single one of us in this room needs water and if we're giving water to these computers that's water that's not going to be serving people human beings so if we're going to be doing a definition about anything relating to utilities it would be very important to actually include a definition for water usage in that definition so that we don't overextend ourselves at the end of the day water is the most vital thing that we're given from the earth and so we need to be taking care of it being a good steward of these resources and being a good steward of our time here on earth so again I appreciate you for the time you give me to speak and I pray that shall make the best decision for the city of New Orleans. Thank you so much. Jesse George. And then we'll move into opposition. Please state your name and address. Thank you. All right. Thank you. Jesse George, 4519 South Claiborne on behalf of the Alliance for Affordable Energy. I spoke before at last month's meeting about this. Really just wanted to come out today. I've already thanked this commission staff for their work on this, but I'd like to thank the public, really, the community, who really was the impetus for this recommended prohibition on citywide, or citywide prohibition on hyperscale data centers. When the rumors earlier this year were swirling about a proposed data center in New Orleans East, the community sprang to its own defense, and this was really a response to that pressure from the community. We see this as a win at the Alliance for Affordable Energy in terms of banning hyperscale data centers citywide. We recognize the nuance and that we already have data centers existing in the city of smaller scale, but really the threat comes from these hyperscale facilities, and that concern is addressed in this prohibition. We would have no objection to a deferral on the vote. We already have a temporary ban in place for a year, so more time for public education about what this new ordinance would entail. We would have no objection to that, but we do see this as a win for the community. Thank you. I have a question for you, just about Mr. Bailey's comment about the water being scarcity. Excellent recommendation. That was my question, how you felt about it. That would be my response to that. Okay, okay. All right, thank you. All right, we are going to move into opposition, and I'll call a couple names so that you're aware that you're coming up. Kenia Smith, Deborah Levy-Perlman, and Asadat Noshi, and I'll apologize in advance if the pronunciation is not accurate. Please correct me when you're up here. It's all right. I've been called worse. Good afternoon, members of the commission. I'm grateful for this opportunity. Kenia Smith, 7033 Lake Willow Drive in New Orleans East, and I'm the interim president of the Eastern New Orleans Neighborhood Advisory Commission, otherwise known affectionately as ENONAC, an organization designed after Katrina to protect the integrity of New Orleans East neighborhoods and our investment in this American experiment. We represent over 75,000 residents, over 70,000 acres, or 65% of New Orleans is land massed, over 40 neighborhoods. And as my letter referenced, we are requesting at least a 60-day deferral of this august body's consideration of this report so that we can have more public engagement. We noticed in the report, and we do commend the staff for their time, that N2G, the Sewage and Water Board, and certain other city departments were engaged in the production, but what was glaringly missing was any input from the most affected communities. So in these two minutes that I have, and the little time that I have left, I do point you back to Louisiana Revised Statute section 3391.11, which does speak to certain procedural requirements that are necessary for certain governmental actions, such as this. One of the things that I've learned in the 30 seconds I have left, that when you are in the position of privilege and leadership, whether it be elected or appointed, there are three things that we need to do for people. The first is to engage. The second is to educate, and the third is to empower, and that is why we respectfully request this deferral so that we have an adequate opportunity to get meaningful community input.
So I thank you for your time, and I see that my time is up. Thank you. It's got to be a bit lower. Good afternoon. My name is Devorah. I'm a New Orleans resident, and I'm a volunteer with the Take Back the Power campaign and an organizer with the Party for Socialism and Liberation. So many of us are mobilizing today because nobody in the community wants a data center in their backyard, big, medium, small, and because we clearly see through the lack of democracy and accountability that we've been seeing. By allowing Entergy to decide whether they can provide grid capacity for a proposed data center, the CPC is putting decision-making about our resources into the hands of a corrupt for-profit corporation. Let's remember this is the same Entergy who in the past year has given over $1.5 million in campaign contributions in Louisiana, the same Entergy who after Hurricane Ida wreaked havoc across South Louisiana, charged customers $3.2 billion for repairs while handing $1.5 million in payouts to their shareholders and giving their then-CEO a $4 million raise. So now what's happening is that they're making these deals with big tech to power data centers. So there's two options here. Either Entergy builds new gas-fired, polluting power plants to power data centers and hike up our utility bills, or and they allow more strain on the already failing grid, causing more blackouts for working-class New Orleanians. We're tired of billionaires putting this system in a chokehold where we regular working people have no control over our resources, over the unreliable utilities that experience frequent outages and that drain our bank accounts. The people should democratically decide how our grid is used, not Entergy. Electricity should be a basic human right, not a commodity for profit, and we the people should have control over how our utilities are used. Thank you. Thank you. Hi, my name is Asada, and I'm a member of the Party for Socialism and Liberation and a volunteer with the Take Back the Power campaign. I'm also a student at LSU New Orleans, and I'm here today because I have serious concerns that this proposed rule will disproportionately harm black and working-class New Orleanians. The proposal says that so-called medium data centers can be located in industrial zoning districts, but we know that zoning has never been a politically neutral act. From a combination of policy decisions like redlining and decades of de facto segregation, black communities have always gotten the short end of the stick when it comes to deciding where quote-unquote undesirable infrastructure is built. Some of the biggest industrial zones in New Orleans are located right next to black communities. For example, the New Orleans East Industrial District is a massive site for industrial exploitation and is based in a community that is 84% black. When we look next to the desired area along Industrial Canal or by the river in the Lower 9, we can see a similar pattern. Black and low-income communities are the ones that have to shoulder the impacts of these invasive industrial projects. It's no secret at this point that people across the city and even across the country don't want a data center in their backyard because they know data centers compromise our quality of life, from draining our water supply to creating absurd levels of noise pollution. When the same communities get targeted over and over again, it's not a coincidence. It's making them a sacrifice zone for big tech to rake in record profits at our expense. So we're here today to demand that this proposal not move forward, that black and working-class New Orleanians not be asked to bear yet another inconvenience, and that you place the welfare of the residents of this city over profits for corporations like Entergy. Thank you. Could you please state your address for the record before I move on? Thank you. Yes, it's 2101 Leon C. Simon Drive. Thank you. Tiffany French, blue, and Bernadette Fox. Hello, Tiffany French, 2326 North Robertson Street. I do support banning hyperscale data centers, but I believe we should be banning data centers of all size in the city of New Orleans because of the detrimental effects already mentioned, such as energy and water depletion, air pollution, noise pollution, and light pollution. Even if tech companies pay to improve our infrastructure and promise not to cause problems, they have proved themselves untrustworthy in the past, and all of this is just to create a handful of jobs and support plagiarism, misinformation, and racist surveillance. There are no benefits to the citizens of New Orleans. Thank you. Thank you. Hello, my name is Blue, 7015 Kentucky Street. I'm not going to be saying anything new here that hasn't already been said, but I am a white transplant here in New Orleans, and I'm here to reach out to all of the board members who are also white and say that this will be the detrimental genocide to the community that is in New Orleans, and everything is owed to the black and brown indigenous community of New Orleans. There is nothing more to be said that we have seen evidence in how this has impacted other communities throughout the United States, that these data centers are not being built in predominantly white communities, point blank. It's not happening, and so everything in this city, the reason why people come here is owed to black and indigenous community members who create it. It's the only reason people come here, is because of that, and I urge you all to listen to people who have spoken before me and to think deeply about the sustainability and keeping this city alive, especially because I know that you all have seen the reports of the point of no return as sea levels rise. How do we want to prolong and keep alive this place that you say that you love and protect, that we say we love and protect? What will we do? So thank you for your time. Thank you. Good afternoon, everybody. My name is Bernadette Fox.
I live at 623 Alvar Street. I am a lawyer. I went to law school here. I'm currently on medical leave because I had to get cancer removed from my body in April. I'm the court-appointed lawyer that you get. I'm a good one, and I'm probably going to have to quit that job because we don't prioritize children and mothers. I'm here as a mother. today of a black child in a city that doesn't prioritize his wellness. The only property I own is the former grave of a student and when I was making that purchase in 2021 after he was killed in the seventh ward that is rapidly being gentrified, I had to decide which cemetery was safe because the graves were floating. Right now we're in a drought, okay? I come from Santa Cruz, California. Paradise on earth. Bigger wealth disparity than here. Greater homeless population than here. We would never have a data center because they protect the environment. Not like Watsonville where Driscoll strawberries come from. You see those at the grocery store. Highest rates of childhood cancer coming out of those communities, black and brown, Hispanic communities in California. So I'm telling you that the choices that you're making around the data center will affect my son's ability to thrive in this city, to thrive in this place, to potentially have generational wealth one day, to have a future, to maybe have his own children one day. You're making those decisions and we will not forget. I will not forget. We are different. We are writing the history books. We will archive the history. Not the people that think that they're in power. The land is destabilizing because of decisions that the people in power have made for time immemorial here. So I'm standing before you and I'm letting you know that people like me who have been in places that have tried to bully us into a cult of silence, it's not happening. Right? My employer probably doesn't know I'm here today. I don't care anymore. I'm speaking truth to power because it needs to happen. Time is up. My time is running out. Our time is running out and we're not going to back down. Period. Ahmed Javar, Kendall Berry, and Kieran Spencer. Ahmed Javar, Kendall Berry, and Kieran Spencer. Hey, my name is Ahmed, 4999 Burgundy Street. I'm an organizer with the Party for Socialism and Liberation and a volunteer with the Take Back the Power campaign. I'm here today to urge the commission to recommend a permanent citywide ban on new principal use status centers. Your staff report highlights the difference between Hyperion and what it would call a medium data center. And yeah, sure, 20 megabytes, not anywhere near Hyperion's scale. But it would still use as much electricity as 12,000 homes per year and occupy an entire city block. So what exactly is medium about that? Would anyone here consider if they got an electric bill for 12,000 divided by the average electric bill, $2.16 million? I can't afford that. I don't know if any of you can. The word medium here really just means larger than small and smaller than large. It has nothing to do with any of the impacts that these facilities will have. Your report acknowledges that data centers primarily affect the cost and availability of electricity and water. It correctly identifies a citywide issue and does not bother to offer any citywide solutions. How does a sound barrier protect us from rate hikes, for example? The proposal is a step backward in policy. We already currently under the ICD are banning new principal use data centers. And instead of making this permanent, we're considering exceptions for small facilities that take as much power as every household in the St. Rock neighborhood combined each, not to mention medium facilities. You're also not doing anything like capping how many data centers can be improved in total or their resource drain collectively. You're missing the forest for the trees with these definitions. These are separate categories on paper, but they're all drawing from the same electrical grid, water system, city, infrastructure. That's our electricity, our water, our city, and our infrastructure. You've been hearing this for months now. Ban all the data centers. Do not permit small facilities or conditional approval for medium. Keep the definition in the current ICD. Maintain narrow exception for accessory server rooms. Recommend that to city council. Prevent all data center use in all zoning districts. Thank you. Hello, my name is Kendall Berry. I live at 2230 Bienville Street, and I'm a volunteer with the Take Back the Power campaign. I'm here to say today that we don't want any new data centers in New Orleans, even if you call them small or medium‑sized. All data centers put significant strain on our already failing power grid, use up precious freshwater resources, and create more pollution. All over the country, people are fighting back against data centers that are being forced on people, fighting for their right to a say in how their resources are used. I talk to people in this city all the time, and I can think of a hundred other things that New Orleanians want for their beloved city before they want any new warehouses for big tech. New Orleanians want a functional pipe system with water that isn't filled with lead or PFAS. We want reliable power that won't leave us stranded in this brutal heat. We want to feel like our city is prepared for the next Katrina that comes to New Orleans. How is paving the way for big tech business to do what it wants with New Orleans beneficial for the average working person here? I'm so tired of hearing about the economic boost that Louisiana will get by selling off more and more of our precious land to these mega corporations who want nothing more than to extract as much as they can from the people of Louisiana, as if they haven't taken enough. We need to prioritize fixing the existing problems in this city, preparing for the actuality of another big storm, and taking care of our struggling people.
What is best for profit-obsessed corporation is not what is best for working-class New Orleanians. I ask you so that you can reflect and because the people deserve to know whose interests are you protecting, the people or the ultra-wealthy. Thank you. Thank you. Kieran Spencer, 1339 St. Rock Avenue. My name is Kieran and I'm an organizer with the Take Back the Power campaign. Here in New Orleans, our grid is already stretched to its limit. Much of the infrastructure we depend on was built more than 70 years ago. We've seen time and time again that it cannot even withstand relatively minor storms without widespread outages. And we know what happens when energy system fails. Working people of this city die. After Hurricane Katrina, energy took 42 days to complete restoration, leaving roughly 1.1 million customers in the dark. In 2021, Hurricane Ida left nearly 950,000 customers without power after an energy tower fell into the Mississippi River. Energy needed 15 days to restore power to most of the city. During that time, at least nine people died from excessive heat in their own homes. Their deaths were preventable. They died because our grid failed them, because energy failed them. Our grid cannot handle strain that climate disasters already place on it, let alone the demands of data centers. And those demands are staggering. We only have to look at Richland Parish. There, energy worked in secret to secure the meta-Hyperion AI data center. The project is expected to consume roughly half of Louisiana's electrical capacity. That's approximately seven times the energy consumed by the entire city of New Orleans. And energy has no real solution for our failing grid. They've stood in this very room and dodged accountability while proposing an enormous new fossil fuel energy system. We cannot fix a failing grid with more Band-Aid solutions. And if energy gets permission to bring any size data centers into New Orleans, working class people will pay the price when the system fails. If this commission is serious about preparing New Orleans for the next hurricane, then you must ban all projects that put additional strain on our failing electrical grid, no matter the size. Allowing any size data centers in New Orleans would mean signing a death warrant for the people who will be left without power when the next disaster hits. Thank you. Thank you. It's either Tay or Terry Giaranelli. And Gregory Snapford. Hello. Tarazan Lewis. Sorry. No, please go ahead. State your name and address. Tay Giaranelli, 1117 Lesseps. And thank you for your time today. I want to say too real quick that you guys don't have enough information. You were given a five slide presentation when the full report is actually 57 pages. And reading and looking at this, the one thing that I did not see in the actual report is that almost a majority of the East is all highlighted and everybody showed up in January and February to shut down that request for a data center in the East for a reason. And now we have done good research to go and point back to the East as our location. Additionally, this is going to be a quick search for profit and money in this city that I know will cost you beyond tenfold in the future with our already failing infrastructure. This is going to continue to be massive detriment. The other thing I want to see and I recommend is I would like to see in here making it costly. Costs as consequences to the corporations, companies, and individuals who want to do this if we're going to be serious about a regulation meaning anything. I'm not footing that bill. Additionally, something that wasn't in any of the report is what is called power usage effectiveness, which is the actual metric that determines the impact. Megawatts is just the instantaneous power draw from IT equipment. And they had nothing about terawatts per year, additionally. PUE is the ratio of total facility power and often smaller facilities and older facilities have the worst, ranging up to 2.5, which has... Thank you. Thank you. Sweet 700, I'm a Southeast Louisiana organizer at Healthy Gulf, co-founder of Culture Cleanliness, proud New Orleanian. Hey man, I just think it's a slap in the face to New Orleanians, particularly residents of New Orleans East. I've spent my fair share of time growing up in New Orleans East, not my entire childhood. But in recent years, there's been a number of community-based organizations, public officials, and concerned residents, man, that have been putting real work to bolster sustainability in our community out there, most specifically, creating opportunities for the children in New Orleans East to access the land, to access the water. It's a shame that we can't access our waterways, like the Gannon Canal, the Citrus Canal, because it's polluted by water hyacinth. And you may be wondering, what does this have to do with data centers? It has everything to do with data centers. We're ignoring the environment. As everyone else has said, I believe that the environmental impacts are not being fully considered. It can't be fully considered, and since this last permit application was submitted, I'm totally against it. The land footprint impact alone would be devastating. It wouldn't be the highest and best use of the remaining of our already eroding land in this city. We have a tremendous opportunity to bolster our recreational water economy. Let's do that. Let's protect our waterways. Right up the road in Ascension Parish has some of the highest cancer rates in the country. We're only 40 minutes from there, y'all. Cancer, heart disease, the number one killer of Americans. Asthma, you know, it's polluted by industries. We got Venture Global down the road in Plaquemines. We got CF Industries up in Ascension. We got carbon capture, LNG, dredging and filling our Mississippi River, wetland destruction.
You really want to take what we have here in New Orleans, the last remaining special part of our state, and destroy it, and then rob our schools and fire departments of tax revenue? Just makes no sense. Thank y'all. Thank you. Thank you. Thank you. Thank you. Thank you, thank you. I'm so sorry. Mr. Lewis? Okay. Fran Bias? Trinity Barnes? And Claudia Celestin? Good afternoon. My name is Fran Bias. I reside at 11311 Parkwood Court South in New Orleans East. I don't know a lot about these data centers. In fact, I guess I learned quite a bit from these young people just sitting there listening to them. But what I have found out, number one, is that these data centers are contracting from 15 to 25 years. So what happens after the 25 years? I understand that they have to build more power plants to energize these data centers. And so when they pick up and leave in 15 to 25 years, who's gonna carry the price tag of those energy centers? And I'm concerned about them building them near residential areas, you know, where people are trying to sleep at night and they're draining the water and the power from those homes. So I don't have a lot of love for a data center. I don't really want them, not near where I have to live anyway. But thank you for listening. Thank you. Thank you. Thank you. Good afternoon, my name is Trinity Barnes. I graduated from Rhodes College with a degree in environmental studies and urban studies. So I study climate change in cities, I study how environmental impacts affect human beings. And I study how governments tend to have a lot of power over long, long-term impacts over what we do here in our city. More importantly than my past studies, I am here as a New Orleanian, a black New Orleanian from the Seventh War. And I'm here to say that we're tired. We're tired of being exploited, we're tired of being looked over, and we're tired of forfeiting the price that million trillionaires get to make more money off of. I'm completely against data centers in New Orleans, big, small, it doesn't matter the size, because we already deal with a lot of pollution here in this city. We're fighting for our lives with Cancer Alley. We're fighting for our lives with all kinds of pollution here. And I wanted to talk about noise pollution specifically, and how that will really affect a lot of our residents, including our children. There isn't much data coming out of these data centers about the negative health impacts that they're causing children. And being that these will be allowed to be entire residential neighborhoods, very close to schools and homes, I just want y'all to keep in mind about the young people coming up, and how they are our future, and how they are negatively impacted by these consequences. Please help us take care of New Orleans. We're the backbone of the South, we're the backbone of this country. Half of this would not be here if it weren't for the Louisiana Purge, and if it weren't for the poor of New Orleans. So please, please, please keep us in your hearts, and please keep us in your minds as you make this very important decision that will impact us forever. Thank you. Ms. Barnes? Ms. Barnes? We just need to be consistent. Thank you. 1612 North Prairie Street. Thank you. Thank you. Good afternoon. Claudia Sullestan, 5706 Louis Prima Drive West, New Orleans East. Member of Enonac Cab. A president of Farber Subdivision. And I came here today to speak for a deferment. And if there is no vote for deferment, I suggest that you all vote this down so that reconsideration can be done for all of those things that people have brought forward today that need to be considered in this document that is to be presented. As far as the community in New Orleans East, for myself, I know I have not had an opportunity in order to digest any part of the recommendations. So when we look at what the community input should be, I'm thinking we do need voices to come out of the community. I do appreciate all of the data, all of the technical information that has been provided. But we also need to know what impact to the community will be brought forward from a rash, rush decision. So I ask for a delay. So you know before, the members of the community did come together when there was a proposed data center in one of the neighborhoods of New Orleans East. It was totally rejected. So I'm asking, please defer a vote down. Thank you. Thank you. Raffael O'Neill and Ronald Marshall. Those are the last cards that I have to speak. If anyone else has filled out one, please make sure that I get a card so you can speak. Yes, hi, my name is Raffael O'Neill, 6319 Rocheblev. I apologize, I'm not gonna be as eloquent because I just heard about this as I was leaving for work. I'm gonna be late picking up my daughter from school, but it's worth it. I actually have a Stop Data Centers Facebook page, I can't even remember the name of it, on Facebook. I've spoken with people in Richland, Virginia. It used to be Richland, the richest soil in Louisiana, in Monroe. And there is nobody who lives by a data center who loves it. It destroys lives, it destroys health, it destroys sanity. It is a curse on communities. It absolutely destroys the lives of the people who live by it. I don't care what size. There are multiple issues. Most people brought them up. They are ultra low frequency weapons. You can put a sound barrier, but the frequency, the vibration that goes through has health effects. One little girl kept getting seizures until her parents were fortunately able to go, leave the, I don't know if they sold their house or not, unless you're selling to the data center. A lot of people renting who are poor cannot, are not so fortunate as to be able to get out of the neighborhoods that they're in or people that can't sell it if the data centers won't buy it. Nobody wants to buy a house in a data center neighborhood. So there's just a lot of health issues that we know about. The quality of life is a nightmare.
I had a friend who was a medic who worked in one of these data centers. I will try not to give too many identifiers. He said he was told that the number one cause of death to look out for as a medic was, for the people building the construction site, was suicide, actually. And you can, he didn't know why. He actually resigned after that. He quit. But there's, these things, whether they're closed loop or open loop, first of all, if they're open loop, they're gonna release a lot of water vapor into the air. Water vapor's the number one cause of, number one driver of climate according to NASA. Even small changes in the location or abundance of clouds can change the climate more than the anticipated changes brought about. Can we turn it back on so at least you can finish your comment, please? And so these create heat islands. And if we're so worried about a rise in one degree, and why are we putting up all these things that are the antithesis of the sustainability narrative that we've been rolling out here all these years? So there's a lot of reasons. There's actually not one good reason to have a data center. China is using those to man the police, the robots and the robot dogs. We know what's coming. This is to monitor us. It's got nothing to do with managing all this data. Please reconsider. Thank you so much. Thank you. Thank you. Woo! Thank you. Woo! Mr. Marshall? Good evening. My name is Ronald Marshall, Senior Policy Strategy Advisor at Experience. I'm also a lifelong resident here in New Orleans. I was born in Charter Hospital, so is my entire line of family. Everybody on this panel knows the harm that those data centers were doing to our communities. So I have to ask, if you know the harm that we are actually considering putting data centers in our community, then some of you must be already bought, like Senator Jay Marshall was bought by the data company to put that data center in North Louisiana. And I mean bought, your values have been compromised. Because there should be a resounding no to data centers in New Orleans East that's predominantly black. How many of you would put a data center in your own backyard and risk your family being harmed? by that data center. Ask that question. Would you do it? How many of y'all live in New Orleans East? How many of you live in New Orleans East because they're predominantly black? My mother been out there 40 years, she rely on tap water. She rely on tap water. She don't have money to buy bottled water. And after Katrina, gentrification pushed the rest of the black people that lived in the middle city in the east. Only black people will be impacted by that data center. So I ask the question, if you know the home of the data center, why are we even considering it? Don't be like Senator Jay Martin, let them buy you and compromise your values. Please, people will be harmed, families will be destroyed, particularly black families. It's an attack on black communities around this country. None of them billionaires will ever consider putting a data center in their own neighborhood. Never. Ever. Thanks. Thank you very much. Thanks. I don't have anybody else on, I have no more cards, so I don't think there's anyone else here to speak on this matter. If you all have any questions for any of the speakers or for staff, please, do, we don't have a, no, no, because it's, yeah, there's no rebuttal because there's a text amendment. Commissioner Aver, please. Thank you. First of all, I want to thank everyone that came out today to speak. And I was just taking a couple of notes, but as Mr. Smith mentioned earlier, no community input was in a report. And correct me if I'm wrong, but it appears as though the two major companies that would be, that would be, well, how should I say it? If they will affect us as rate payers, our NTG and Sewardian Water Board. The main, the one guy that mentioned attend boil water issues in New Orleans East. I mean, why would we even, or why would the data centers be proposed in the East if that's a problem? And in looking at this map, it's like many of them are proposed for New Orleans East and some areas of the city don't have any red shading. We already have a problem with NTG, you know, in the city, in the East, if we've experienced after hurricanes and what have you. So that would definitely be a problem with these data centers. Also in a large areas of that shaded area, there are near schools and hospitals and senior citizen housing. I can see that potentially being an issue, but actually I would like to make a motion now, but you know, if anyone else wants to make a comment, go on. I'd just like to make a comment that a big issue for me is that there's, there will be no enforcement and you can come up with a guideline that may or may not be followed and it just doesn't work in this scenario. We have a slew of existing buildings that you wanna shove a data center into and how do you make that work and meet all of these requirements of a specific guideline? I'm not for any, for a data center of any size in New Orleans, but that's really what comes down to for me is just, you know, the energy impact, the impact to our infrastructure and the reality that, you know, enforcement just might be something that's not really possible without having good data and there's just not that data right now. Commissioner Jackson. I personally, for one, I wanna put on record, I do reside in New Orleans East. Okay, so I heard you loud and clear. Me and Commissioner Hebert. So number two, I took some notes as well and just as a young person that's looking forward to raising a family in New Orleans, from a business standpoint, they're trying to argue that it's money, tech and growth, but then when you look at it from a community standpoint, the kinds are energy use, water use, and environmental pressure and we have to look at what's gonna be the quality of life for the next generations to come.
So sometimes we have to understand, are we looking at today or are we looking at the future of tomorrow? So I personally supported being deferred, but I do not support data centers, especially if it's not gonna be accountability, it's not gonna be education and we need to understand what is the end goal, what is the objective for being a data center in the city of New Orleans? Thank you. Thank you. Thank you. Any other comments? We also, Commissioner Hebert does have a motion that. I'd like to make a motion. I have a comment, if I may. Okay. Thank you. Good afternoon, everyone. I wanna distinguish between opposing regulation and supporting a deferral here today. I absolutely think that the city needs a permanent regulatory framework for data centers. The question before me today, though, is whether that framework in front of us is sufficiently developed to become that permanent framework. The CPC staff itself recognizes that data centers are unusual because many of their most significant impacts aren't traditional land use impacts. That involves electricity, water capacity, utility costs, noise, and potentially regional infrastructure consequences. Those are significant issues, and I want to be confident that the standards we recommend actually address them in a clear and enforceable way. For example, the proposal requires pre-review by Curo, Entergy, and the Sewerage and Water Board, but it leaves the procedure for those reviews to be created by those entities. Before we establish a new use category in the zoning ordinance, I think it's reasonable to understand more clearly what the review will entail, what standards will govern it, and what happens if utility capacity or community impacts are unacceptable. A deferral gives us an opportunity to resolve these remaining questions without creating an immediate regulatory vacuum. My concern is that once we create permanent permissions in the CZO, even conditional permissions, as what is being suggested here today, we've established an affirmative pathway for applications, and I want to make sure that the standards governing that pathway are as strong, specific, and administratively workable as they need to be before we recommend adoption. Now, I recognize that this matter has already received substantial study, and I don't take another deferral lightly, truly, but the amount of time we have spent is not by itself the measure of whether the ordinance is ready. I'm asking us to defer because once we create a legal pathway for these issues, I want the guardrails around that pathway to be fully defined. The relevant question is whether the outstanding issues are material, and given the scale of the potential utility and community impacts, I believe they are. Thank you. Any other comments? If not, okay. Commissioner Hebert, motion, please. I'd like to make a motion to defer this item for 60 days, and I will ask that community input will be involved with the final report. What's the deadline again? It's 10 to 3. I believe it's 59 days away. Yeah, I'm not sure we got 60 days. Is there a second? I second. If we don't have 60 days, that's going to... It's 59 days. So... We have a first and a second. Yes, Mr. Rivers? Number one, as to the timeframe, I will reach out to Councilmember Hughes and Councilmember Morrell, who initiated the motion, to see if they will accept a slight extension to that time so that we can... So I have no problem doing that. The second, is there any... In addition to Commissioner Poche's suggestions as far as what we can do in the time period between that, if you've got other things for us to consider and bring back more information, we'd certainly be able to do that. Yeah, I do have that. Do we have a motion and a second? Yeah, first and a second, so please discuss. I'd like to ask staff... So, first of all, we gave staff a compliment last time, and I want to give them a compliment again. It was a really thorough report, but we've also now heard a bunch of other ideas and facts. So I'd like to ask, in the space of the deferral, the things that struck me that I'd like to ask staff to address are, one, before I do, I think setting 20 megawatts as the floor beyond which it's large and hyperscale is very good because it's low. I've looked at data to see the megawatts used by the centers that really put fear in everybody's, and they're above 20, so I think 20 is a good floor. But I'd like to ask staff to consider lowering the floor for medium so that it's harder to get to medium, which would mean that... Or lowering the floor so that more things are medium and fewer things are small, so that it's harder to put up a data center. It's harder to be a small data center that has less restrictions. Second, we've heard that maybe some standards about water usage, in addition to square footage and megawatt use, would be helpful to maybe define what category somebody falls into. I'd like to ask if you could look at the 500-foot from a residence. That still seems small to me, and I wonder if it could be a larger distance. You may have to consult with legal, but I'd like to see a proviso that all of the data and all of the information that's used to make the decision about what capacity, what category something falls into, is public and not kept secret. You know, we've heard a lot about nondisclosure agreements in North Louisiana, and I'd like to see if we can add a condition that requires any application. or any data center to have full information available to the public. I don't know if it's possible to require medium data centers to have their own power plants so that they aren't drawing from the grid that serves residential homes. I know throughout the country sometimes they build their own power plants. I don't know if you could look into that. And I don't know if there's, it's a laundry list, but these are things that everybody has, that I've gleaned from the comments.
And I think Commissioner Poche's comment was apropos that this is really serious and we want to cover all these points. And I hate to put all the work on you, Laura, but you've done such a good job so far that maybe you can handle all this stuff. I did hear a suggestion that maybe there'd be a limit, so many data centers per, and I don't know what, per radius of some distance so that they don't all get concentrated in the same place, if there are going to be any. So if you could look into some of those issues, I think that would be good if at our next meeting those could be addressed, you know, one way or the other. And I have a few more to add. Please. That the institutional limitations be the same as defined for the small and medium. There was just sort of a caveat that it could apply to those educational and medical campuses, but not necessarily saying that it needs to meet those same requirements. I would also want to identify a distance limitation to schools. And in the report, it does say that there's no on-site power generation, and I'm just wondering why that was stated. Yeah, we looked at that, and it seemed from what we gathered, the information we started seeing was that when there was on-site power generation, you start to get into a different world of permitting and allowances, and you start getting into more air quality issues and other types of potential negative impacts, and so we pulled that possibility from data centers to be able to generate their own power in this report. But we can dive again into that and look at on-site power generation specifically for medium and see if there's more standards or regulations that could be put in place. It's just a different space than we usually work in, so we might need to pull some other. And it'll usually limit itself out just based on those regulations alone. Yeah. And the last was, you know, the International Building Code, the IBC is coming up with this guideline for data centers, and I would just request that we consider whatever that guideline is that we exceed that, so not just meeting the minimum standard, but requiring above and beyond in both instances of small and medium. I'll add to Commissioner Flake's, just in schools, but also distances to retirement or memory care facilities, you know, just of our aging population, I'm on the fence about, you know, I realize as planners we also need to define the data centers. I could do an outright band, but I understand this practice up here and this discussion is good, you need to be able to define something first. So I will support this motion as we go ahead and start a vote. Are there any other comments? I do have a list of requests, if we were to defer, that the staff would explore. And I can provide these so you don't need to write them quickly. Develop a clear utility review standard and approval criteria. Establish ongoing monitoring and reporting requirements. Clarify enforcement mechanisms and consequences for noncompliance. Evaluate requiring closed loop cooling systems. Evaluate cumulative citywide utility impact limits. Strengthen standards for backup power generation. Develop decommissioning and site restoration requirements. Likewise, emergency response and shutdown requirements. And evaluate whether pending data center building code standards warrant additional provisions. Any more? You're good? Okay. Well, then I'll call the vote. Commissioner Steeg? Yes. Commissioner Whittry? Yes. Commissioner Flick? Yes. Commissioner Aeber? Yes. Commissioner Koepper? Yes. Commissioner Poche? Yes. Commissioner Jackson? Yes. All right, so the motion carries. This is deferment for 59 days. And the executive director is going to ask the councils that went ahead and produced this text amendment to work with us on timing. Thank you all for coming today and spending your afternoon with us and sharing all of the data points and advocating for your neighborhoods and the city of New Orleans. We're going to move on now to the capital improvement project. Ms. Bryant's on again. Yes. Yeah, Poche? You seconded the motion. Oh, Jackson. The other piece, yeah. I was like, that was Jackson. I said Jackson. Jackson? Hey, how are you? Sorry, very focused. It was nice to see you. All right. All right, we're very excited to hear what you have to share. So this first one is the amendment to the capital improvement plan. This is to serve as a public hearing for eight additional requests, which weren't submitted to us by the time the plan was being considered. So the first two requests were included and will be included in the plan. The other six requests are additional requests that are requests for bond funding that were made earlier this month as a cost-saving metric by the administration. The request is to pay for six different projects through capital that are eligible for capital bond funding. The first is for a cyber infrastructure refresh for $4.2 million, and the second is for repairs to the city's data center on the third floor for $1.7 million. The next two are... Excuse me, Ms. Bryan. I'm just... You all... Excuse me, everybody. If you don't mind just sort of moving away from the mic just because we do have some more business that we need to conduct today. Thank you all so much for coming. I want to be able to hear what Ms. Bryan is saying. All right, continue, please. Yes, the next two requests are from the CAO's office. They're for a fire station alerting system for $2.4 million and justice technology modernization project for $25.3 million. The next request is from DPW for traffic signal mast arm upgrades at $778,000. The next is for biosafety lab updates for mosquito, termite, and rodent control board for $298,000. The following one is for new police dog kennels for NOPD, $117,000. And the last of these amendment requests is for capital improvements for New Orleans public schools for $5 million. Staff recommends essentially approval of this amendment report.
It's just so we can include all of the proposed projects within the capital improvement plan. So we'd be looking for an approval to add these. All right. Is there any questions or a motion to go ahead and add these eight projects? Commissioner Jackson. Yes, I want to ask for a motion on the floor to approve the eight provisos. Projects. Oh, I'm sorry. The other P. Projects. All right. Is there a second? I second. Thank you. Commissioner Jackson and seconded by Commissioner a bear. Any discussion? If not, let's go ahead and vote. Commissioner Jackson. Yes. Mr. Poche. Yes. Mr. Kepper. Yes. Mr. A bear. Yes. Yes. Mr. Flick. Yes. Mr. Witry. Yes. Commissioner Stieg. Yes. Okay. So we'd love to include these eight projects in the capital improvement draft amendment. Okay. All right. Now we're going to move on. So this is the 2027 through 2031 capital improvement plan. Um, okay. Today we're going to go through the legal background and CPC responsibilities. The CIP development process, just describe the funding categories, provide an overview of the funding requests and analysis of the submissions by categories and project types, and then provide proposed priorities, recommendations, and next steps. So the legal background and CPC responsibilities, the charter requires that the city planning commission prepare the capital improvement plan and assist the chief administrative officer in the preparation of the annual capital budget. The capital improvement plan includes five years of proposed capital expenditures from 2027 through 2031 staff reviews, each project to ensure consistency with the master plan. The plan for the 21st century, a project is consistent with the master plan. If it furthers, or at least does not interfere with the goals, policies, and guidelines in the land use element of the master plan, or the project is compatible with the proposed future land use. While some projects do not have specific addresses, they are consistent by contributing to goals or policies within different chapters of the master plan. The CPC works closely with Kyle Homan, capital budget director, and Jerry Harris from capital projects administration to coordinate the capital plan each year. The submissions were due on May 1st and CPC held public hearings from May 18th through May 27th for departments to present their requests. It's being considered today and is required to be submitted to the mayor by September 15th. So the development process, the process kicks off in April with a webinar for. the agencies, and then each agency works with Capital Projects' liaison to coordinate their submissions. This year, we used the software Questica, as we did last year, for the first time to receive all of the individual project requests. Once the requests are submitted online, the staff collects and reviews each request and then holds the public hearings for the departments to present each request. We also had IT develop a public-facing dashboard with the project information so it's more accessible to the public. The staff reviews each request for master plan consistency and compiles the capital improvement plan. So the funding categories, there are four, really four main funding categories. It's general obligation bonds, self-generated funds, intergovernmental funds, and then federal grant funds, either from U.S. Department of Transportation or from EPA. This year, 27 agencies submitted a total of 187 requests. Most of those are for general obligation bonds. Some were from the self-generated funds, and then there were intergovernmental and federal funds for the projects. Largely, okay, next page. Projects that are requests for capital funds fell under a short number of categories. Staff spent time this year categorizing each project submitted to gain an understanding of what types of requests are primarily going through the CIP. Primary categories include planning, which are requests generally referring to studies, design work, feasibility analysis, or pre-construction activities needed before a project can move forward. Renovation or continuing maintenance requests involve repair, rehabilitation, replacement, or ongoing upkeep of existing facilities and infrastructure. Equipment requests cover the purchase or replacement of major items such as vehicles, machinery, or specialized operational equipment. Technology requests include hardware, software, systems, or infrastructure that supports public services and administrative operations. New construction requests are for building new facilities or major additions, while land acquisition requests involve purchasing property needed for future use. Majority of requests are for repair or continuing maintenance of existing facilities. So during the process, the departments rank their projects in two ways. The first way is by identifying which of the projects are the highest priority to the department. The second is by ranking each project against 19 criteria to generate a score within an evaluation matrix. Upon analysis of the department's priorities versus the CIP matrix scores, the data revealed that the projects that scored the highest with the departments were not always the highest scoring CIP matrix project. The data showed that the nature of the highest ranked projects by the department tend to relate to immediate operational needs and deferred maintenance, while the CIP matrix favors assets, longevity, resilience, and multi-benefit public infrastructure. And so this table basically shows the highest matrix scoring projects ranked by the department or I'm sorry, the highest matrix scoring projects, the amount requested, the score, the department that submitted the project, and also you'll see that they are separated into different funding tiers. We received 187 requests and they range in terms of total project amount of funding.
So as opposed to just doing by the highest amount requested in order to really capture the diversity in the capital project needs requests, we broke them out into different fiscal tiers. I have a question. Have we really dug into the deferred maintenance issue in terms of like that being part of a capital expenditure versus just something that we have to do? So to qualify to be part of the capital program, the dollar value has to be over $5,000 and it has to be a lifespan of 10 years. And so you do get these sort of large investments that are continuing maintenance and renovation of facilities that are, you know, HVAC repair, elevator repair, these large expenses. But Kyle, Mr. Homan is here and he does do an analysis of each request to make sure that it meets the- I'm curious when those dollar amounts were established. How the- Like when? When? The 5,000? It just seems- Like what year? You know, it just seems low for just the price to do anything at this point. We can look into that. Okay. Thank you. Questions? Are we keeping up with the next? So during the CPC review period, staff conducted three site visits, one to the NOLA Crime Lab, the Public Safety Warehouse, and the Mirabeau Water Gardens. While many of the issues in terms of the NOLA Crime Lab are general maintenance issues for the NOLA Crime Lab, part of the request is also to redesign the fourth floor to allow for compliance with federal regulations in order to gain access to an FBI database. This would allow the department to conduct nationwide DNA searches in-house. Currently the facility is inadequate and it's designed to receive this access, so that's a part of that one request. The Public Safety Warehouse is a request to increase capacity, improve the existing facility to further support the needs of our emergency service providers, NOFD, EMS, and the NOPD. And the Mirabeau Water Gardens project has made significant progress. The public park portion of the site is slated to open soon, and a portion of the site, as you can see, is also still under construction, but that is one of our stormwater management projects coming online. So big stuff. Okay. So unlike last year, the amount of bond funds that are available to be allocated is $0.00 that have been attributed to the projects. That's because last year the CIP was informed by the bond proposition that went out to the voters in the fall of 2025. The voters approved a $510 million bond initiative, and so there were allocations throughout the CIP last year, sort of allocating that potential future bond sale. This year, what we have heard is that the $510 million will be sold at three different moments. The first group of the $510 million was sold this summer. We have Kyle here who could provide more information. The city council adopted project lists based on the submissions from last year for infrastructure for stormwater and green infrastructure and, oh, sorry, stormwater and drainage. And then affordable housing was the third bucket of projects under the bond proposition, and those would be determined by the Housing Trust Funds Advisory Committee. And so all the requests this year you'll see in the capital improvement plan are that all the requests that are submitted for bond funds will have a $0 recommendation, and that is because any of these future bond sales that will happen to fulfill the $510 million will go to those projects that are on those lists. What we do know is that those lists can be amended. They have been amended twice so far. One of our recommendations for those future sales is that the projects that are prioritized are continuing maintenance and renovation of existing facilities as opposed to the creation of new facilities. We see so many of those projects coming in. And the other recommendation we have is to modify that list to include some of those projects that were previously removed from the list, which is the Juvenile Justice Intervention Center. They had a series of projects last year that we recommended for funding, and then they were removed from the infrastructure list, and so we recommend that would be put back on. And I think that concludes mainly. Okay, so the next steps, basically today we're presenting it to you. This would be approved, and then it has to be sent to the mayor by September 15th, and the administration will prepare the capital budget and submit it to the city council, and then the city council will hear the capital improvement plan and the capital budget and approve a capital budget ordinance by December 1st. And then... That was an exceptional presentation. There's so much information. I'm just amazed at all of the inner workings here, and I'm going to just... We have four new commissioners, but this is your first capital improvement project presentation, so we're welcome. We're glad that you're here to be able to listen to it and be a part of this process. It's annual, and so I think we're probably going to have... Are you going to come up and say anything? Maybe? Yes? I mean, I think it would be helpful to introduce yourself, just because we also have four new commissioners, and for institutional knowledge, it would be nice. My name is Kyle Holman. Oh. Can you hear me? Now we can. All right. There we go. Thank you. There, I can hear. All right. Good afternoon. My name's Kyle Holman.
I'm the director for capital budget and fiscal management, and so Laura had mentioned earlier, this is our second year having everything submitted in Questica, which has really helped us efficiency-wise with this entire process, so that has given us the opportunity at looking at how we can make this process better in future years, so we've done a lot of analysis and beginning that work of what will future CIP processes look at, whether we're looking at maintenance and operation costs that come along with these CIPs, a stronger definition of what constitutes a repair versus what constitutes a renovation and more eligible for the capital budget, and just in addition to that, being able to look at the different funding sources because we rely heavily on bonds but also federal grants to get a lot of these projects done, and so we are making improvements every year with kind of this process, and we've already also talked about kind of what incorporating Susan Waterboard into our capital budget planning will look like for the future, because that was recently required by the council starting this year and moving forward, because especially with our public works projects, every time we're tearing up a street, we need to coordinate closely with Susan Waterboard on those underground utilities at the same time, so having that planning together at the beginning will help kind of avoid these issues about who's paying for what. and not having to dig up streets, you know, after they've already been paved. Thank you so much. It's nice just being, this is probably my fifth or sixth year listening, and I can tell the last two years it's been more streamlined, great presentation, more efficiency involved. And so we love hearing those things and we're seeing it as well. So thank you. Y'all have any questions? Should we come up with a list of things for staff to pursue like we did last time? Yes. Yes. Commissioner Flick, did you want to? Okay. I was just genuinely curious about the minimum amount, just because in order to do pretty much anything, even replace a very small AC unit or even lights, can easily eat up that minimum amount. So just in terms of like how, you know, we have all this data that appears to be electronic, right? Like how are we evaluating that data and using that to sort of trim the fat, if you will, on how we operate on an annual basis for, you know, what can be just ongoing maintenance versus what's really a capital expenditure. I think that that's something really interesting that we can sort of hold onto now that we have the data in this sort of format. Thank you. That's exactly why I asked. Yes, Commissioner Steele. I move approval. Thank you. Is there a second? I'll second. Thank you. We have a motion on the floor for approval for the capital improvement plan. Is there any discussion? All right. Let's vote. Commissioner Steele? Yes. Commissioner Whitry? Yes. Commissioner Flick? Yes. Commissioner Hebert? Yes. Commissioner Kepper? Yes. And Commissioner Poche? Yes. Okay. And Commissioner Jackson? Yes. Thank you. So the motion carries. Good luck. Thank you. And I believe we can now move into the subdivision ratifications. Thank you for being here. Thank you. Okay. Thank you, ladies, too, for a great report. You have several subdivisions to ratify. All right. Is there a motion? So moved. Thank you. Is there a second? Second. Thank you. Commissioner Flick moved for approval. Commissioner Jackson second. Any discussion? All right. Commissioner Jackson? Commissioner Poche? Yes. Commissioner Kepper? Yes. Commissioner Hebert? Yes. And Commissioner Steele? Yes. Commissioner Hebert? Yes. Commissioner Flick? Yes. Commissioner Witry is a yes. Yes. And I'll need a motion to adjourn. Motion. Thank you. Second. All in favor? Aye. Aye. Everyone. Thank you for helping us today with all the tech, too. I know you can hear me. All right. Yeah. Yeah. We did a great job. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Iawn, na fyddwn i'n tyfu! Mae'n sgwrs. Mae'n sgwrs.
